Os recomiendo que vayáis a la web de la oficina de patentes de USA,
http://patft.uspto.gov/netahtml/srchnum.htm y busquéis la número 6,368,227
Es un ejemplo de las barbaridades que pueden llegar a patentarse sin que nadie lo impida; en este caso la 'invención' consiste un columpio compuesto por dos cadenas, un asiento, y la rama de un árbol:

"SUMMARY OF THE INVENTION

In accordance with one embodiment of the present
invention, a method is provided for swinging on a swing. The swing comprises a seat for supporting a user that is suspended between two chains that are hung from a substantially horizontal tree branch. The method comprises the steps of:
a) positioning a user on the seat; and
b) having the user pull alternately on one chain to induce movement of the user and the swing toward one side, and then on the other chain to induce movement of the user and the swing toward the other side, to create side-to-side motion. In another embodiment of the invention, the swinging method may be practiced independently by the user to create the side-to-side motion from an initial dead stop. These and other features of the invention are described in greater detail below. "

O sea, que tus hijos infringen patentes y tú sin saberlo...

Esto lo encontré mientras descubría por qué Gimp no soporta CMYK y Photoshop sí (obviamente, es por una patente). Imaginad qué pasará con las nuevas patentes de software. Si ya hay problemas ahora, ¿qué es lo que nos espera?

Las patentes caducan, generalmente en 20 años.Por tanto la del columpio estaria ya caducada si hubiera sido admitida, que lo dudo.

No, esto se patentó en el 2000 (es un invento del siglo XXI, o casi). Y claro que fue admitida, por eso se puede consultar.

racional sólo cree lo que ve y para no creer en eso no va a visitar la página, hay que ponerselo delante de los ojos para ver si así le da la gana de abrirlos. En principio pensé que racional se refería a "razon", pero poco a poco y por sus comentarios me he dado cuenta de que posiblemente se refiera a "ración".
