Declaració d'indymedia Bristol (28 de juny)sobre el segrest del servidor i la detenció d'un voluntari

On Monday 27th June the police raided a residential property in Bristol and seized an Indymedia server and other computer equipment. They also arrested one person for incitement to criminal damage under common law. That person has since been released on bail. We see this police action as an attack on the freedom of speech and journalistic independence.
This police action relates to an article posted on 17th June in which persons unknown claimed to have damaged cars being transported on a train. This article was considered by Bristol Indymedia to have breached the guidelines and was hidden.
On Monday 20th the police contacted Bristol Indymedia with reference to this posting. Bristol Indymedia informed the police that they were in the process of instructing a solicitor to reply on their behalf. On Tuesday 21st the police contacted a Bristol Indymedia volunteer requesting the IP logs. Bristol Indymedia considered that the system was journalistic material covered by special provision under the law.
A solicitor from Liberty faxed the police explaining this provision. The police then contacted Bristol Indymedia to request a meeting which Bristol Indymedia agreed to. Ten minutes before the arranged meeting DI Bennett of British Transport Police cancelled the meeting and asked to postpone it.
The next police contact was the seizure of the server and the arrest of a Bristol Indymedia volunteer. The seizure of the server was carried out under a search warrant (police and criminal evidence act 1984, ss.8 and 15), not recognising the journalistic privilege.
Additional Statement:
"We are outraged at the actions of the police. They have completely disabled the entire Bristol Indymedia news service. By their actions they have undermined the principle of open publishing and free access to the media, thereby removing people's opportunity to read and report their own news. This situation has serious implications for anyone providing a news service on the Internet. We do not intend to let this stop us from continuing the project." |

El dilluns 27 de juny, la policia va assaltar una propietat residencial a Bristol i va segrestar el servidor d’indymedia i d’altre equipament informà tic. També varen arrestar una persona amb l’acusació d’incitació al dany criminal sota llei ordinà ria. Des de llavors aquesta persona ja està en llibertat sota fiança. Veiem aquesta acció policial com un atac a la llibertat d’expressió i a la independència periodÃstica.
Aquesta acció policial es relaciona amb un article publicat el 17 de juny en el qual persones desconegudes reclamaven haver atemptat contra uns cotxes que eren transportats en tren. Des de Indymedia Bristol es considerà que aquest article havia infringit la polÃtica editorial i fou ocultat.
El dilluns dia 20 la policia va contactar Indymedia Bristol referint-se a aquesta notÃcia publicada. Indymedia Bristol va informar a la policia que estaven en el procés de nomenar un advocat perquè els respongués en nom seu. El dimarts dia 21 la policia contactà un voluntari de Indymedia Bristol demanant els registres d´IP’s. Indymedia Bristol considerà que el sistema era material periodÃstic cobert per llei amb provisions especials.
Un advocat de Liberty va enviar un fax a la policia explicant aquesta provisió. Llavors, la policia contactà Indymedia Britol per demanar una trobada amb la qual Indymedia Bristol hi estigué d’acord. Deu minuts abans de la trobada prevesta, DI Bennett de la Policia de Transport Brità nica cancel.là la trobada i demanà de postposar-la.
El següent contacte policial fou el segrest del servidor i l’arrest d’un voluntari* d’Indymedia Bristol. El segrest del servidor es dugué a terme sota mandat policial (police and criminal evidence act 1984, ss.8 and 15), sense reconeixer el privilegi periodÃstic.

“ Estem escandalitzats davant de les accions de la policia. Ells han incapacitat completament la totalitat del servei de notÃcies Indymedia Bristol. Amb les seves accions han soscavat el principi de publicació oberta i d’accés lliure als mitjans de comunicació, i amb això han pres a la gent l’oportunitat de llegir i explicar les seves pròpies notÃcies. Aquesta situació té serioses implicacions per qualsevol que proporcioni serveis de notÃcies per internet. No deixarem que això ens aturi de continuar el projecteâ€? |

amb la LSSI, aquí no hi hauria tantes floritures, no? amb la llei a la mà vull dir...estil "ley corcuera". Indymedia està obligada a facilitar les dades a les primeres de canvi? serveix d'alguna cosa tenir un servidor a un altre estat?
què pot passar si algú es nega a facilitar la informació d'IP's? |

si no m'equivoco, tota la responsabilitat cau sobre l'administrador de la màquina on està allotjada la pàgina (pel tema de fer pressió sobre les empreses que dónen aquest tipus de servei i així tancar portes a qui vulgui tenir webs que no agradin a l'estat)
però també buscarien el propietari del domini
per anar bé hauria d'estar a nom d'algú que visqui fora de l'estat i també la màquina, llavors la cosa és més complicada perquè aconsegueixin tancar-la (almenys a l'"estil corcuera")
